Terms of Service

1. Acceptance of Terms

By accessing or using the Murgh Leadership Assessment platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and Murgh ("we," "us," or "our"). Your continued use of the Service following any updates to these Terms constitutes acceptance of those changes.

2. The Service

Murgh provides a software platform for administering 360-degree leadership assessments designed to support executive coaching engagements. Coaches use the Service to create assessment projects, invite raters, and generate scored feedback reports for their clients. The Service is intended for professional use in the context of leadership development and coaching, and is not a substitute for clinical psychological assessment or medical advice.

3. Accounts

Coach accounts are created and managed through Clerk, our third-party authentication provider. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

4. Survey Participants

Raters and survey participants access the Service through unique token-based links delivered by email — no account creation is required. By submitting a survey response, participants acknowledge that their responses will be processed and included in aggregated feedback reports delivered to the relevant coach. Participants should complete surveys honestly and in good faith, and should not attempt to identify or de-anonymize other respondents.

5. Acceptable Use

You agree not to misuse the Service or help anyone else do so. Prohibited conduct includes, but is not limited to: submitting false, misleading, or fabricated survey responses; attempting to reverse-engineer, scrape, or systematically extract data from the platform; circumventing anonymity protections or attempting to de-anonymize individual respondents; and using the Service for any unlawful purpose or in violation of any applicable regulation. We reserve the right to investigate and take appropriate action, including account termination, in response to suspected violations.

6. Data Ownership

Coaches retain ownership of the assessment data they collect through the Service, including survey responses and generated reports. By using the Service, you grant us a limited license to process and store that data solely for the purpose of delivering the Service to you. Aggregated, de-identified data may be used to improve calibration norms and the accuracy of scoring models; such use will never expose individual respondent data.

7. Service Availability

The Service is provided on an "as-is" and "as-available" basis. We do not guarantee any specific level of uptime and reserve the right to modify, suspend, or discontinue the Service — or any part of it — at any time with or without notice. We will make reasonable efforts to notify users in advance of planned maintenance or significant changes, but cannot be held liable for any interruption of service.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Murgh and its affiliates, officers, employees, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising out of or in connection with your use of or inability to use the Service. Our total liability for any claim arising under these Terms shall not exceed the amount paid by you to us in the twelve months preceding the claim.

9. Changes to Terms

We may revise these Terms at any time by posting an updated version on this page with a new "Last updated" date. We will provide reasonable notice of material changes via email or a prominent notice within the Service. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.
